Many times in our office we hear this from clients. Here’s the bottom line on this issue. Some employers in some states have what is called a right of reimbursement. This means that if the health insurer pays for medical bills incurred as a result of an accident it can collect out of your injury settlement the amount it paid. It cannot refuse to pay your medical bills. You have paid a premium out of your wages to have health insurance and it doesn’t matter whether your need for a doctor and hospital is because you got hepatitis, got hit in the nose by someone, or hit in the rear by a big truck. Whether you will have to pay any of those medical payments back to your health insurer depends upon the state in which you live, whether your employer is self insured or whether you work for the federal government.
